General Site Access:
Gordon's grants you a non-exclusive, non-transferable, limited right to access, use and display the Site and the materials thereon for your personal use only, provided that you comply fully with these terms and conditions of use. You shall not interfere or attempt to interfere with the operation of the Site in any way through any means or device including, but not limited to, spamming, hacking, uploading computer viruses or time bombs, or the means expressly prohibited by any provision of these terms and conditions of use.
Datastore and CD-ROM Access:
Gordon's provides you with storage media and/or on-line database services containing computer programs and data (the "Program"), user manual and/or help file, License (the "License"), and accompanying documents (together called the "Software") and grants you a license to use the Software in accordance with the terms of this License. The Software which accompanies this License is the property of Gordon's or its licensors and is protected by copyright law.
The Software and other features which may become available in the form of "Upgrades" or "Updates" represent the service subscription ("Service") for this Gordon's product. The Service extends either for one year only from the date of the issuance to you by Gordon's of the original password (which makes the Software fully functional), or the next annual release of the Software in the case of CD-ROMs, whichever comes first.
While Gordon's continues to own the Software, you will have certain rights to use the Software after your acceptance of this License. The issuance to you of your password constitutes acceptance of this License. Except as may be modified by a license addendum which accompanies this License, your rights and obligations with respect to the use of this Software are as follows:
YOU MAY:
use the Software on two computers, whether office, home, or portable;
use the Software on multiple computers or networks after purchasing "Site Licenses" for each additional station accessing the Program;
if the Software is networked, Site Licenses for the Software are issued for each additional physical location of the network, and the Program may only be accessed through Local Area Networks ("LANs"). Additional subscriptions to the Software and additional Site Licenses must be purchased if the Software is used at multiple locations, even if the Software is accessed through a single network.
if the Software is an upgrade or update from a prior Program, you may use or transfer the Software only in conjunction with the upgraded Program and you may only use that upgraded Program in accordance with this License; and
after written notice to Gordon's, transfer the Software on a permanent basis to another person or entity, provided that you retain no copies of the Software, destroy any prior upgrades and/or updates, and the transferee agrees to the terms of this agreement.
YOU MAY NOT:
use the Software or make copies of it except as permitted in this License;
sublicense, rent, transfer, or lease any portion of the Software, except as set out above;
reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Software, create derivative works from the Software, or modify the Software or merge all or any part of it in or into another program.
Ownership and Restrictions
Gordon's owns, controls, licenses, or has the right to use and provide, all material on the Site, including, without limitation, text, images, articles, browsers, interfaces, photographs, illustrations, and audio and video clips (collectively the "Content"). The Site is protected by copyright as a collective work and/or compilation, pursuant to U.S. copyright laws, international conventions, and other copyright laws. Gordon's is the owner of the copyright in the entire Site. Gordon's owns a copyright in the selection, coordination, arrangement and enhancement of the Site. You agree to abide by any and all copyright notices, information, or restrictions displayed on the Site.

Since the Software contains proprietary source codes and encrypted data, once you are granted a password to make the Software fully functional, you may not return the product for a refund.
Gordon's provides technical support, information, and assistance only for the current release of the Software.
Indemnification
You shall indemnify, defend and hold harmless Gordon's, and all its officers, directors, owners, agents, employees, Content providers, affiliates, licensors and licensees (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, and claims and all fees, costs, expenses, of any kind related thereto (including, without limitation, reasonable attorneys' fees) incurred by the Indemnified Parties in connection with any claim arising out of, based upon, or resulting from, your use of the Site. Applicable Law
These terms and conditions of use shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflicts of laws provisions. The sole and exclusive jurisdiction for any action or proceeding arising out of or related to these terms and conditions of use shall be an appropriate State or Federal court located in Maricopa County in the State of Arizona, and you hereby irrevocably consent to the jurisdiction of such courts.
